UPCommons as a copyright management tool

10 reasons to post on UPCommonsUPCommons, the open access portal to the knowledge of the UPC, is formed by the set of open institutional deposits of the UPC Its mission is to guarantee the preservation of the teaching and research output of the University's scientific and technical research, maximizing its visibility and, consequently, increasing its impact on teaching and research around the world.

This deposit allows the authors:

  • Guarantee the identification, dissemination and preservation of the deposited works
  • Granting a Creative Commons license to the works, preserving the ownership of copyright
  • Have an additional evidence of the authorship
  • Have a means of contact that allows communication with researchers, entrepreneurs or other potential users interested in the works
  • Learn about the visits and downloads made from each work from different countries

The deposit of works with free access to UPCommons offers the following advantages related to its identification, dissemination and conservation:
 

Identification
  • All production of the UPC is accessible through a unique portal (avoiding the dispersion of content for the various websites and / or intranets of the university).
  • The deposited work is described very accurately and, therefore, the correction is guaranteed bibliographic citations that can be done in the futur.
  • From the record of each work, the corresponding bibliographic citation can be automatically generated in the desired format: ACM, APA, Harvard, ISO 690, MLA, etc.
  • All deposited documents are uniquely, perpetually and normally identified by a uniform resource name (Handle or DOI), avoiding possible broken links associated with the document (theURN differs from the URL in that it identifies the object, not the place where it is located).
Preservation and conservation
  • The institutional repository meets all the technical requirements necessary to guarantee the preservation and preservation of documents, deposited on secure servers managed by Libraries, Publications and Archives Service (for example, migrating to new formats and / or platforms).
Visibility
  • Interoperability of deposited documents is guaranteed through a standardized description of these documents according to the international metadata standard. Dublin Core and the use of the protocol Open Archives Initiative - Protocol for Metadata Harvesting (OAI-PMH)
  • This language and protocol are those that allow the collection of descriptive metadata by other open access repositories and, therefore, the retrieval of documents from these repositories (RECERCAT, RECOLECTA, OPENAIRE, ...). Obviously, this increases the visibility and impact of the work in research and teaching around the world.

When an author (and / or holder of rights) submits a document to UPCommons, authorize in a non-exclusive way its reproduction and public communication. Therefore, although he allows this communication on the network, he remains the sole owner of the exploitation rights, as detailed in the corresponding distribution license:

By clicking on this license, you (the author or the copyright owner) guarantees the UPC The non-exclusive right to distribute your shipment worldwide in electronic format.

You also agree that the UPC You can keep more than one copy of this shipment for security and preservation purposes.

The duration of the transfer of rights will be indefinite and may be terminated by unilateral complaint of the author / assignor, by termination of both parts of mutual agreement or for failure to comply with any of the parts of the obligations contained therein.

Declare that the submission is an original work, and / or that has the right to grant the rights contained in this license. It also declares that its submission does not infringe upon the copyright of any person.

If the shipment contains materials that it does not have the copyright, it declares that it has obtained the permission without restriction of the owner of the copyright to grant to the UPC the rights required by this license and that the owner knows the text or content of the consignment.

If the submission is based on a work that has been sponsored or supported by an agency or organization other than the UPC, it is assumed that any right of revision or other obligations required by such contract or agreement has been met.

    If the author (and / or holder of rights) wishes, he can optionally grant one of the licenses Creative Commons, which details the specific uses that users can make of their work, without having to ask for permission (without and when they do so under the conditions detailed in the license).

    • The works that are offered under these licenses can be reproduced, distributed and publicly communicated, although the author can also authorize other more permissive uses such as modification and / or commercialization of the same.
    • In any case, the original authors always have to cite and recognize themselves, as well as indicate clearly the conditions of the license in case the work is reused or disseminated.

    The authors have all the legal benefits contemplated in the Intellectual Property Law (LPI), regardless of whether their works are accessible in paper format or in digital format. Therefore, although this communication is made online, the author should not carry out any additional action to protect their own rights. In this way:

    • No one can use the work without authorization or in the cases provided for by law. That is to say, only because of the fact that it is indicated in the work that is the author, this already constitutes valid evidence.
    • In the event that a person has plagiarized a work or made any other use not permitted by law, without the consent of the corresponding owner, you can request the immediate cessation of the illegal activity (with possible compensation) and / or file a lawsuit, as detailed in the articles 138 / 143 of the LPI. In this case, any evidence Ownership can be useful.

    Taking into account these premises, the authors of the documents deposited with free access to UPCommons they have another tool with which to manage the following aspects related to their own copyright:
     

    • Keep in mind that the deposit of the works registers the date and time the files were deposited, which can be a proof of their authorship (Other registration and identification systems of the works are, for example, the Intellectual Property Registry or Safe Creative):

    dc.date.lift allows you to search for documents, temporarily with closed access, for the year from which they can be consulted with free access (once their embargo period has expired)

    In the case of confidential documents that have been seized, it allows you to search for them by the date from which their files could be consulted with free access (it only appears once the embargo period has expired)

    • In the case of digital works, some can also be used plagiarism detection program with which to trace partially or totally coincident documents disseminated on the Internet. Therefore, while digital documents can be copied more easily than those on paper, it is also easier to automatically detect possible unauthorized uses.

      The section "See usage statistics"of each community ofUPCommons, offers the visits and downloads made of the documents deposited therein:

      These totals can be viewed in the countries from which visits and downloads were made, as well as for the years and months in which they were carried out.
